Catch.com.au Flybuys Competition - Terms and Conditions

1. Definitions

For this Promotion, the following terms have the following meanings:

Term	Meaning
AEDT/ AEST	AEDT means Australian Eastern Daylight Time. AEST means Australian Eastern Standard Time.
Immediate Family	Any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin
Promoter	Catch.com.au Pty Ltd (ABN 22 149 779 939) of 240-246 East Boundary Road, Bentleigh East, VIC)

Promotion Period	12AM AEST on 22/09/2020 - 11:59PM AEDT on 13/10/2020

2. Eligibility

Australian residents aged 18 years or over are eligible to enter this Promotion. Employees of the Promoter or immediate family members of an employee of the Promoter, Flybuys or an agent of the Promoter, who is directly associated and connected with the organisation of this competition, are not eligible to enter this Promotion.

3. Entry

By entering this Promotion, the entrant accepts these terms and conditions. A person may only enter this Promotion during the Promotion Period. In order for the Promoter to notify the winners, the entrant must provide his or her full name and e-mail address. The Promoter may deem an incomplete entry invalid. To be eligible for the draw, entrants must be a Flybuys member (www.Flybuys.com.au) and a have an active Catch account (www.catch.com.au). Entrants must ensure that their Flybuys and Catch accounts remain linked for the duration of the Promotional Period.

Entrants will automatically be entered into the Promotion as follows:

i. To receive 1 one (1) automatic entry into the draw, entrants must link their Flybuys member number to their Catch account during the Promotional Period. Members who have linked prior to [12:00AM AEST] on 22 September 2020 are ineligible to receive entries in the Promotion by the linking entry method. Each account may only be linked once during the Promotion Period and each Entrant is limited to one entry by the linking entry method;

ii. Customers that have linked their Flybuys member number to their Catch account will receive one (1) automatic entry per $10 spent on Eligible Products* at Catch.com.au, during the Promotional Period; and

iii. Club Catch members that have linked their Flybuys member number to their account and have an active Club Catch membership at the time of the transaction, will receive two (2) automatic entries per $10 spent on Eligible Products* at Catch.com.au, during the Promotional Period.

*Eligible products exclude shipping costs, Club Catch membership fees, gift cards and Catch Connect services.

As entry into the Promotion occurs automatically, any person who does not wish to enter the Promotion must advise the Promoter by submitting a request via the Helpdesk [https://help.catch.com.au/s/] and the Promoter will deem that person’s purchased products or linking entry ineligible to enter the Promotion.

4. Prizes

There will be 1 x First Prize winner and 100 x Second Prize winners. The First Prize winner will receive 1 million Flybuys BONUS POINTS (valued at AUD$5,000) (‘First Prize’). Each Second Prize winner will receive 10,000 Flybuys BONUS POINTS (valued at AUD$50 each) (‘Second Prizes’). The total prize pool will be valued at AUD$10,000. Prizes are not transferable or exchangeable and cannot be substituted for cash. Flybuys points can be redeemed at www.Flybuys.com.au and will be subject to the Flybuys terms and conditions, available at https://www.Flybuys.com.au/about/#/Flybuys-terms-and-conditions. If a prize is unavailable, the Promoter may substitute that prize with a prize that is equal in value or type subject to any written directions from a regulatory authority.

5. Draw

The winners of the prizes will be drawn at random from the pool of valid entrants on 3PM AEDT on 20/10/2020 by an approved electronic drawing system. The first valid entry drawn will be the winner of the First Prize and the second and subsequent valid entries drawn will be the winners of the Second Prizes. The draw will take place at the Promoter’s office located at 240-246 East Boundary Road, Bentleigh East, VIC.

6. Winners

The winners of the prize will be announced on the Promoter’s social media account https://www.facebook.com/CatchAustralia/ at 3PM AEDT on 22/10/2020. After announcement of the winner, the Promoter will notify the winner via email. Each prize will be automatically allocated to the Flybuys account associated with the winner’s entry by 27/10/2020.

7. Unclaimed prizes

If a prize is unclaimed, the Promoter will draw a winner for the unclaimed prize 3 months after the initial draw 3PM AEDT on 20/01/2021 using the same method specified in section 5 and will notify the winner using the same method specified in section 6. The draw will take place at the Promoter’s office specified in section 5.

8. Forfeited prizes

The Promoter may forfeit a prize if a winner refuses to accept a prize.

9. Entrant’s personal information

By entering this Promotion, the entrant consents to:

a. the Promoter, or any of its affiliated entities, using the entrant’s details for future marketing and promotional purposes, except if notified otherwise by the entrant;

b. if entrants are winners, the Promoter using their name, likeness, image and voice in any media platform; and

c. disclosing the entrant’s personal information to third parties, including agents, contractors and suppliers of the Promoter. For the Promoter’s privacy policy, please see https://www.catch.com.au/privacy.

10. Prohibitions and Promoter’s rights

a. This Promotion is subject to the Promoter’s ‘Fair Entries and Participation’ policy. Entrants are prohibited from and will have entries disqualified where the Promoter determines that an entrant has abused, misused or otherwise dishonestly or deceptively entered the promotion or manipulated the results of the Promotion. Entrants will be disqualified where, in the Promoter’s opinion, they are tampering or have tampered with the entry process, using or have used automated entry software or other mechanical or electronic means that allows a person to automatically enter repeatedly, using or have used multiple entries (unless specifically allowed by the Promoter), entering or have entered on behalf of another person(s), or otherwise tampering with the entry process.

b. The Promoter may verify the validity of entries and entrants (including an entrant's identity, age and place of residence). The Promoter may disqualify an entrant or winner where the Promoter determines that such entry is not in accordance with these terms and conditions, including the circumstances set out in clause 10.a. above. The Promoter may either disqualify an entrant or modify, suspend, terminate or cancel this Promotion if this Promotion is interfered with or this Promotion is not capable of being conducted as reasonably expected due to a reason beyond the control of the Promoter, including technical difficulties, unauthorised intervention or fraud, subject to any written directions from a regulatory authority.

11. Promoter’s liability

The Promoter is not liable for any loss, expense, damage or liability that may be suffered or incurred by a person in entering this Promotion or accepting and using the prizes. If the Promoter is liable, the Promoter’s liability is limited to either resupply of the goods or services. This section 11 does not alter a person’s rights under the Australian Consumer Law.
